1. Introduction

Welcome to Art is Lit, an online marketplace where independent artists (“Sellers”) can list, promote, and sell original artworks and handmade items directly to customers (“Buyers”).

By accessing or using Art is Lit, you agree to these Terms of Service, our Privacy Policy, and our Returns & Refunds Policy. If you do not agree, please do not use the platform.

2. Role of Art is Lit

  • Art is Lit is a facilitator of sales between Buyers and Sellers.

  • Sellers are the merchant of record and are responsible for listing accuracy, fulfilment, shipping, and handling returns/refunds.

  • Art is Lit does not own, inspect, or guarantee artworks.

3. Account Registration

  • You must be at least 18 years old to register.

  • You may sign up using email/password or social login (Google, Facebook).

  • You are responsible for maintaining account security and keeping your login details private.

4. Seller Responsibilities

Sellers must:

  • Only list original artworks, handmade items, or authorised prints that they own the rights to sell.

  • Provide accurate descriptions, prices, and shipping details.

  • Fulfil orders promptly and pack items securely.

  • Handle returns and refunds according to our Returns & Refunds Policy.

  • Comply with all applicable laws (consumer protection, tax, export restrictions).

5. Buyer Responsibilities

Buyers must:

  • Ensure their shipping and contact details are accurate.

  • Review listing details carefully before purchasing.

  • Communicate promptly with Sellers regarding issues.

  • Cover return shipping costs when required by the Returns & Refunds Policy.

6. Prohibited Use

You may not use Art is Lit to:

  • Sell counterfeit, stolen, or infringing items.

  • Misrepresent artwork origins, materials, or editions.

  • Spam, harass, or defraud other users.

  • Circumvent platform fees or conduct off-platform sales intended to avoid commission.

7. Orders, Payments & Fees

  • Payments: Processed securely via Stripe, PayPal, or Wise. Art is Lit does not store card details.

  • Currency: Listings default to GBP (£). Buyers are responsible for currency conversion and related costs.

  • Commission: Art is Lit charges Sellers a 10% commission per completed sale.

  • Transaction Fees: Sellers are also responsible for payment provider transaction fees:

  • Payouts: Sellers receive net earnings (sale price minus commission and transaction fees) once payment clears.

8. Shipping & Delivery

  • Sellers must provide accurate shipping times and carrier details.

  • Buyers will be notified of dispatch and tracking where available.

  • Responsibility for risk passes to the Buyer upon confirmed delivery.

9. Returns & Refunds

  • Refunds and returns are governed by the Returns & Refunds Policy.

  • Buyers may receive refunds for: damaged items, defective or incomplete items, items significantly not as described, or non-fulfilled delivery (vendor responsibility).

  • Returns and refunds are handled by the Seller, not Art is Lit.

  • If Sellers do not respond within policy timelines, Buyers may escalate to Art is Lit for mediation.

10. Intellectual Property

  • Sellers retain rights to their own artworks but grant Art is Lit a limited licence to display images and descriptions for marketing and platform use.

  • Users may not copy, reproduce, or distribute artworks or listings without permission.

11. Dispute Resolution

  • Buyers and Sellers should attempt to resolve disputes directly.

  • If unresolved, Art is Lit may mediate but is not obligated to decide outcomes.

  • For payment-related disputes, PayPal, Wise, or Stripe may investigate under their buyer protection programs.

12. Limitation of Liability

  • Art is Lit is not liable for artwork quality, authenticity, shipping delays, or non-performance by Sellers.

  • To the maximum extent permitted by law, Art is Lit disclaims all implied warranties.

13. Termination

We may suspend or terminate accounts that violate these Terms, our policies, or applicable law. Users may delete their accounts at any time.

14. Updates to Terms

We may amend these Terms from time to time. Updates will be posted with a new effective date. Continued use of the platform after updates constitutes acceptance.
